Tom Homan, the immigration Tsar, clashed with the media over President Trump’s decision to invoke the Alien Enemies Act of 1798. Trump made this decision in an executive order targeting the Venezuelan gang Tren de Aragua. The law would allow Trump to deport foreign nationals without a hearing or trial in times of war or invasion. The decision was limited to members of the gang, nonnaturalized citizens, and some other groups.
Tom Homan spoke to the press about the president’s historic decision. In the brief clip, which was posted on March 17, 2025, Homan sparred with a journalist over whether the decision was constitutional. He also took to his government X account to post a larger statement.
In the short video, Homan can be seen taking questions from the podium. A reporter tried to score cheap political points by remarking that the law was over two centuries old. Homan fired back, “Well, the Constitution is a lot older than that, and we still follow it.”
In a longer statement posted on the same day, Homan provided additional reasoning. He said, “The Biden Administration released thousands of Venezuelan Tren de Aragua criminals into the US. They have committed armed robberies, sex trafficked young girls, attacked US citizens, assaulted our police, and r*ped and murdered young women and children.”
The border Tsar also explained how deporting this gang would make America safer. He said, “But now, thanks to the American people, we have President Trump! Last night, 238 Tren de Aragua members along with 21 MS13 gang members, were deported from this country adding to the thousands of criminal aliens already deported. ”
He continued his remarks by reiterating his support for the president. He said, “Under President Trump’s leadership, this country is becoming safer every day. With each criminal illegal alien being deported, neighborhoods are becoming safer. Criminal illegal aliens, gang members and national security threats can try to hide with the help of sanctuary cities.”
The border Tsar concluded his statement by explaining that ICE is committed to solving the issue. He said, “However, know this, ICE will not stop until they are found and deported. This important work, that ICE is doing will continue while Attorney General Pam Bondi takes the sanctuary jurisdictions to court. We have much more to do AND IT WILL BE DONE!!!”

Donald Trump issued an executive order titled “Invocation of the Alien Enemies Act Regarding the Invasion of The United States by Tren De Aragua.” During the order, he said, ” Pursuant to the Alien Enemies Act, the Attorney General and the Secretary of Homeland Security shall, consistent with applicable law, apprehend, restrain, secure, and remove every Alien Enemy described in section 1 of this proclamation. The Secretary of Homeland Security retains discretion to apprehend and remove any Alien Enemy under any separate authority.”
He also added, “All executive departments and agencies (agencies) shall collaborate with law enforcement officials of the United States and with appropriate State, local, and tribal officials, to use all lawful means to apprehend, restrain, secure, and remove Alien Enemies described in section 1 of this proclamation.”
