According to recent reports, the Trump campaign and the Republican National Committee have filed a lawsuit against the state of Nevada over a law that allows mail-in ballots to be counted up to four days after Election Day.
Based on the law, mail-in ballots can be counted within four days of the election as long as they are postmarked before the end of the day on Election Day. The lawsuit, also supported by the Nevada Republican Party, claims this is at odds with federal election law and is biased toward Republicans.
The lawsuit was filed in the U.S. District Court for the Eastern District of Nevada, naming the Democratic Nevada Secretary of State Francisco Aguilar along with other county clerks and registers of Washoe and Clark County.
RNC Chair Michael Watley stressed that the Nevada rule violates federal law and compromises election integrity. “Nevada’s ballot receipt deadline clearly violates federal law and undermines election integrity in the state. Ballots received days after Election Day should not be counted — the RNC and our partners are suing to secure an honest election, support Nevada voters, and oppose unlawful schemes,” said Whatley.
The Republican-led legal effort maintains that the law dilutes valid ballots with the “untimely, invalid ballots,” which undermine all parties involved in the state’s political process, particularly Republicans. The suit emphasizes that this is misaligned with federal law.
“The result of Nevada’s violation of federal law is that timely, valid ballots are diluted by untimely, invalid ballots, which violates the rights of candidates, campaigns, and voters under federal law,” per the lawsuit. “Counting mail ballots received after Election Day doesn’t just dilute the valid ballots — it specifically and disproportionately harms Republican candidates and voters.”
The legal initiative seeks to prevent Nevada election officials from counting ballots received after election day this November. Reports indicate that Nevada will be a hotly contested swing state between Joe Biden and Donald Trump.
According to a statement from Aguilar, his office would not comment on the active litigation. “Our office will not comment on ongoing litigation, but I hope the RNC is putting as much time and energy into educating voters on how to participate in elections as they put into suing the state of Nevada,” the Nevada secretary of state said.
The American Tribune reported late last year that former President Trump packed a 19,000-person arena at a Nevada rally, demonstrating his immense popularity in the swing state. The Reno-Sparks Convention Center was filled to its maximum capacity with energetic Trump supporters.
