Sen. Adam Schiff (D-CA) has recently faced calls from conservatives to be held accountable for supposed crimes he has committed that would not be encompassed by former President Joe Biden’s sweeping preemptive pardon that was granted earlier this year to members of the January 6 Committee.
During Biden’s final hours in office back in January, he extended numerous pardons to his political allies and family members, including figures such as Dr. Anthony Fauci, Gen. Mark Milley, and the January 6 Committee. The move highlighted a palpable fear that President Donald Trump would quickly move to uncover crimes committed by these individuals and hold them accountable.
Conservative commentator Nick Sortor wrote on X, “ REMINDER: Adam Schiff was ONLY pardoned for J6 committee-related offenses NOT the Russia hoax. Not election interference. Nothing else.” Sortor suggested FBI Director Kash Patel would move to expose Schiff. “Kash is going to take this criminal down. Watch. The Hammer of Justice is coming,” he concluded.
In similar news, The American Tribune recently reported on comments from litigation attorney Jesse Binnall, who explained how the pardons from Biden could backfire on the recipients. “The pardons are actually great news. No one who was just pardoned will be able to refuse to testify in a civil, criminal, or congressional proceeding based upon the 5th Amendment,” he said. “And let’s just be realistic. Most of these disgusting individuals would probably have to be charged in Washington, DC, which doesn’t convict partisan leftists.”
He added, “A requirement of asserting the 5th Amendment is that one has to reasonably believe that the information sought could be used in a criminal prosecution. While I’m not aware of any specific cases where a pardoned individual has attempted to assert the 5th Amendment on such circumstances, it’s difficult to see any legal basis for an assertion in regards to pardoned conduct.”
President Biden issued a statement about the pardons, which read, “In certain cases, some have even been threatened with criminal prosecutions, including General Mark A. Milley, Dr. Anthony S. Fauci, and the members and staff of the Select Committee to Investigate the January 6th Attack on the United States Capitol. These public servants have served our nation with honor and distinction and do not deserve to be the targets of unjustified and politically motivated prosecutions.”
It continued, “On January 6, 2021, American democracy was tested when a mob of insurrectionists attacked the Capitol in an attempt to overturn a fair and free election by force and violence. In light of the significance of that day, Congress established the bipartisan Select Committee to Investigate the January 6th Attack on the United States Capitol to investigate and report upon the facts, circumstances, and causes of the insurrection. The Select Committee fulfilled this mission with integrity and a commitment to discovering the truth.”

Speaking more about J6, Biden said, “Rather than accept accountability, those who perpetrated the January 6th attack have taken every opportunity to undermine and intimidate those who participated in the Select Committee in an attempt to rewrite history, erase the stain of January 6th for partisan gain, and seek revenge, including by threatening criminal prosecutions.”
