    Senators Move to Impeach Judge Boasberg, Remove Him from the Bench

    In a huge move that could signal a massive change in attitude from the GOP contingent in the United States Senate towards being more self-consciously in favor of directly aiding President Trump and his administration, Senators Tommy Tuberville (R-AL) and Eric Schmitt (R-MO) moved to both help push along the impeachment of Judge Boasberg and, pending that, get him suspended from the bench as the impeachment is considered.

    As background, many in the GOP have demanded that Judge Boasberg be impeached not only because of his involvement in the witch hunt against President Trump, but for his involvement in Operation Arctic Frost, in which the Biden regime illegally spied on sitting GOP senators. That involvement has led to even somewhat moderate senators, like Ted Cruz, calling for his impeachment, which could be a major step forward in the effort to remove and punish him.

    Such is what Sen. Tuberville’s office announced in an epic, late November press release, noting, “U.S. Senator Tommy Tuberville (R-AL) joined U.S. Senator Eric Schmitt (R-MO) in writing a letter to D.C. Circuit Chief Judge Sri Srinivasan calling for the administrative suspension of Chief Judge James Boasberg while Congress considers Articles of Impeachment for abusing his judicial authority to target the Trump administration, sitting Republican Senators, and conservative organizations.”

    Justifying the decision, the press release noted, “On November 4, 2025, Articles of Impeachment were filed against Judge Boasberg for his role in Operation Arctic Frost, the Biden administration’s effort to target and spy on sitting Republican Senators, including Sen. Tuberville. Judge Boasberg is accused of improperly granting gag orders to shield Jack Smith’s political witch hunt.”

    Further, the senator’s office noted that Arctic Frost was far from the only dire abuse of power in which he engaged, saying, “This is not the first time he has been accused of abusing his power. Earlier this year, he was accused of using his role as Chief Judge for the U.S. District Court for the District of Columbia to assign himself J.G.G. v. Trump, a case that the Supreme Court later found he lacked jurisdiction to handle.”

    In the letter itself, the senators said, “We write to you regarding Chief Judge James ‘Jeb’ Boasberg of the United States District Court for the District of Columbia. Chief Judge Boasberg should be administratively suspended pending formal impeachment by the House of Representatives and, if impeached, an impeachment trial by the Senate.”

    Then, after justifying the impeachment in much the same terms as the press release, the letter noted that there would be precedent for suspending Judge Boasberg while he faced impeachment, saying, “There is precedent for administratively suspending a judge pending an impeachment inquiry. The most recently impeached judge, G. Thomas Porteous, Jr. of the Eastern District of Louisiana, was administratively suspended prior to his impeachment while the Judicial Conference of the United States investigated allegations against him of bribery and fraud. As Chief Judge of the applicable circuit judicial council, you are tasked with overseeing the Article III remedial process for the misconduct of the appellate and district judges of your circuit.”

    Adding to that by pressuring the judge to whom they were writing yet further, the collection of senators noted, “On July 28, 2025, the Department of Justice filed a formal judicial misconduct complaint against Judge Boasberg, pursuant to 28 U.S.C. § 351(a). Under 28 U.S.C. § 352, you are mandated to ‘expeditiously’ review this complaint and determine whether to take ‘appropriate corrective action’ or dispense with the case ‘by written order stating his . . . reasons.’ On information and belief, you are yet to take any published steps regarding this very public complaint.”

    They added, on that same point, “Given you have not entered an order under 352(b), we assume you are following your duties under 28 U.S.C. § 353, which mandate that you ‘shall promptly’ establish a special committee ‘to investigate the facts and allegations contained in the complaint.’ While this impeachment process proceeds, we must have transparency regarding the actions the Circuit Judicial Council is taking against the judicial misconduct of Chief Judge Boasberg.”
