President Donald Trump and his administration scored a massive victory on the night of Monday, April 7, with the United States Supreme Court ruling 5-4 in his favor to strike down Judge Boasberg’s attempt to block his use of the 1798 Alien Enemies Act to deport Tren de Aragua and MS-13 gangsters to El Salvador.
As background, in mid-May, the Trump Administration announced that it would be invoking the John Adams-Era law to start deporting gangsters connected to gangs that the Trump Administration has deemed terrorist organizations. When the first plane was in the air, taking dozens of them to El Salvador’s CECOT prison, US District Court Judge James Boasberg issued an injunction and demanded the plane turn around and bring the gangsters back to America, starting a major legal battle with the Trump Administration.
As the fight escalated, Judge Boasberg insisted that his injunction was valid and the Trump Administration had to comply, while President Trump and his lawyers insisted that the leftist judge was significantly exceeding his authority, and that the 1798 law clearly applied to Venezuelan gangsters who have invaded America.
The court, in an unsigned, 5-4 per curiam opinion, did not address the question of Boasberg’s authority. Instead, it ruled that the Trump Administration can continue with the deportation flights but that it has to give the alleged gangsters notice that they will be deported and the opportunity to contest those deportations on a case-by-case basis, something that could significantly slow deportation efforts.
Reactions to the ruling were mixed. The Trump War Room X account quickly declared victory, saying, “BREAKING 
SCOTUS permits the Trump Administration to continue to remove Venezuelan nationals who are suspected members of Tren de Aragua from the United States under the Alien Enemies Act of 1798.”
Similarly, Attorney General Pam Bondi declared victory and sounded off on Judge Boasberg, saying, “BREAKING: The Supreme Court sides with the Trump Administration on the Alien Enemies Act. Tonight’s decision is a landmark victory for the rule of law. An activist judge in Washington, DC does not have the jurisdiction to seize control of President Trump’s authority to conduct foreign policy and keep the American people safe. The Department of Justice will continue fighting in court to make America safe again.”
Additionally, President Donald Trump declared victory in a post on his Truth Social social media platform, saying, “The Supreme Court has upheld the Rule of Law in our Nation by allowing a President, whoever that may be, to be able to secure our Borders, and protect our families and our Country, itself. A GREAT DAY FOR JUSTICE IN AMERICA!”

However, the anti-Trump ACLU also seemed to see the ruling as something of a victory, as its Lee Gelernt said in a statement to NPR: “We are disappointed that we will need to start the court process over again in a different venue, but the critical point is that the Court rejected the government’s remarkable position that it does not even have to give individuals meaningful advance notice to challenge their removal under the Alien Enemies Act. That is a big victory.”
