A legal watchdog recently sounded the alarm on the Biden-Harris administration, claiming it broke the law with an “entirely political” email to Medicare recipients, labeling it “egregious and outrageous.” The group filed a complaint with the U.S. Office of Special Counsel last week, calling out the Biden-Harris Department of Health and Human Services (HHS) and arguing that its email should be investigated as a potential violation of the Hatch Act.
The filing cited a report from the Daily Wire regarding a taxpayer-funded email circulated in September from the HHS. The email was reportedly sent to all who signed up to receive updates from the Medicare program. It featured a message from President Biden discussing the “historic reforms” implemented to the Medicare program, to which he gave credit to Vice President Kamala Harris.
The email reportedly advertised the Biden-Harris administration’s agenda on “lowering health costs” for senior citizens while aiming to “save money for American taxpayers.” It also credited Harris for casting the tie-breaking vote that afforded Americans these benefits. The statement further emphasized the Democratic position that healthcare should be a “right” granted to all citizens.
Kendra Arnold, the executive director of the Foundation for Accountability & Civic Trust (FACT), called for accountability in a recent letter to Special Counsel Hampton Dellinger. “We request the Office of Special Counsel investigate whether Department of Health and Human Services (HHS) Secretary Xavier Becerra and other federal employees violated the Hatch Act by sending a blatant political email to Medicare recipients,” the letter read, as reported by the Daily Wire.
Arnold continued, “The unsolicited email was paid for by HHS and utilized identification rolls kept by the Centers for Medicare and Medicaid Services (CMS). The email was entirely political in both its purpose and language, it was sent to citizens who are Medicare recipients from an official government email address and from an official department.”
The FACT executive director claimed that the Hatch Act was designed to prevent this exact kind of political activity from within the federal government. “This type of political advocacy from a government agency targeting citizens who interact with it is exactly the type of politicalization of government functions that the Hatch Act is designed to prevent,” she said.
Arnold explained that the alleged violation of the Hatch Act was “egregious and outrageous,” noting that “it involved a potentially massive universe of government data,” given the millions of email addressed the message was sent to. Many recipients of the email criticized it, claiming, “It is nothing but a campaign ad for the Biden Administration and Kamala Harris.”
“The government endorsement of a political candidate and the use of taxpayer-funded resources to do so is the exact political behavior forbidden by the Hatch Act,” Arnold continued, calling for the Biden-Harris administration to be held accountable. “This example is so obvious, brazen and over-the-top that not acting on it would be a significant blow to the integrity of the law.”
“Thus, we urge the Office of Special Counsel to immediately act and investigate whether Secretary Xavier Becerra and other employees of the Department of Health and Human Services and Executive Office of the President violated the Hatch Act,” Arnold concluded, pressing the special counsel to conduct an investigation into the matter.
