Unsurprisingly, Judge James Boasberg has made yet another controversial ruling on immigration. He unilaterally declared that non-citizens deported to El Salvador’s maximum-security prison under the 1798 Alien Enemies Act must be allowed to challenge their removals and their alleged gang affiliations.
For context, Judge James Boasberg became infamous after he used his power to block Trump from invoking the Alien Enemies Act to deport Venezuelan gangsters in a dramatic case of judicial overreach. One of many activist judges, Boasberg came to symbolize the significant issues with the judiciary to many conservatives.
Starting off his biased ruling, the judge dramatically related the dicision to a Franz Kafka novel before pivoting to the case at hand, he said “Such was the situation into which Frengel Reyes Mota, Andry Jose Hernandez Romero, and scores of other Venezuelan noncitizens say they were plunged on March 15, 2025.”
Continuing the decision, Boasberg said, “In short, the Government must facilitate the Class’s ability to seek habeas relief to contest their removal under the Act. Exactly what such facilitation must entail will be determined in future proceedings.”
Still not done, the woke judge said, “Although the Court is mindful that such a remedy may implicate sensitive diplomatic or national-security concerns within the exclusive province of the Executive Branch, it also has a constitutional duty to provide a remedy that will ‘make good the wrong done.’”
Whining about the plight of the violent gang member, Boasberg stated that, “Defendants plainly deprived these individuals of their right to seek habeas relief before their summary removal from the United States — a right that need not itself be vindicated through a habeas petition.”
Concluding his obviously flawed logic, he said, “But — and this is the critical point — there is simply no way to know for sure, as the CECOT Plaintiffs never had any opportunity to challenge the government’s say-so.”

As you can imagine, Judge James Boasberg has heard harsh condemnation from the Trump administration. As we reported, White House Press Secretary Karoline Leavitt demolished the infamous Judge Boasberg in a March 19, 2025, press conference.
Starting off her demolition, she said, “The judge in this case is essentially trying to say that the president doesn’t have the executive authority to deport foreign terrorists from our American soil. That is an EGREGIOUS abuse of the bench. This judge does not have that authority.”
Building on this point, she said, “It is the opinion of this White House and of this administration, and that’s why we’re fighting this in court. And it’s very, very clear that this is an activist judge, who is trying to usurp the president’s authority.”
Proving Boasberg’s DNC bias, she declared, “Under the Alien Enemies Act, the president has this power, and that’s why this deportation campaign has continued. And this judge, Judge Boasberg, is a Democrat activist. He was appointed by Barack Obama. His wife has donated more than $10,000 to Democrats, and he has consistently shown his disdain for this president and his policies, and it’s unacceptable.”
