Jack Smith Is Freaking Out Now that He’s Under DOJ Investigation

In a very, very funny turn of events, former Special Counsel Jack Smith is under fire from the Trump Department of Justice (DOJ) for what it is characterizing as his politicized investigation and prosecution of President Donald Trump, and now he is freaking out and alleging that the investigation into him is politically motivated and he did nothing wrong.

The turning of the tables comes as the DOJ digs into the former special counsel’s two prosecutions of President Trump, both of which were dropped after the president’s victory in the November election, and examines whether they were politicized. Smith has retreated behind attorneys to claim that he did everything by the book, which many on the right doubt given the obviously political nature of what he did.

According to the outlets that reported on the matter, namely Fox News and ABC News, Smith’s panicky response through his attorneys came after Tuesday, August 26, reports that the Department of Justice Office of Special Counsel is investigating Smith and whether his two prosecutions of the president were baseless.

Covington and Burling attorneys Lanny Breuer and Peter Koski sent an angry letter to acting Office of Special Counsel (OSC) Jamieson Greer, arguing in their angry, fear-filled letter that Smith did nothing wrong. Beginning, they claimed, with poetic justice weighing against them, “The predicate for this investigation is imaginary and unfounded.”

Continuing, ABC News reports, their letter went on to claim that Smith did every single thing by the DOJ book as he waged his lawfare campaign against the then-former president. It said, “A review of the record and procedural history demonstrates the opposite — Mr. Smith was fiercely committed to making prosecutorial decisions based solely on the evidence, he steadfastly followed applicable Department of Justice guidelines and the Principles of Federal Prosecution, and he did not let the pending election influence his investigative or prosecutorial decision-making.”

Further, the two attorneys said, according to Fox News, “Mr. Smith’s actions as Special Counsel were consistent with the decisions of a prosecutor who has devoted his career to following the facts and the law, without fear or favor and without regard for the political consequences, not because of them.”

Also in their angry letter, the two attorneys hilariously insisted that it was only for partisan reasons that Smith was being investigated at all, ignoring as they did so the genesis of his lawfare asault upon Trump. They said, “This investigation is premised on a partisan complaint that suggests the ordinary operation of the criminal justice system should be disrupted by the whims of a political contest.”

Concluding the obviously worry-filled letter, the two attorneys then insisted. “In light of the unprecedented nature of this investigation, if you intend to go forward with this in any way, we insist that you engage with us so that any finding by the Office of Special Counsel is fully informed by the record.”

The DOJ OSC investigation of Smith was pushed along by Sen. Tom Cotton (R-AR), who wrote a letter in which he alleged that Smith was trying to shape the 2024 election, saying, “Many of Smith’s legal actions seem to have no rationale except for an attempt to affect the 2024 election results—actions that would violate federal law.”
