In a hilarious moment, an immigration judge ordered the deportation of Rafael Andres Rubio Bohorquez, a Venezuelan national employed as a data analyst by the New York City Council. DHS identified him as an undocumented immigrant who overstayed a 2017 B2 tourist visa, had no work authorization, and had a prior assault arrest.
For context, he was detained in January 2026 during a routine immigration appointment. NYC officials, including Council Speaker Julie Menin and Mayor Zohran Mamdani, condemned the ruling, claiming he had legal authorization and that the order stemmed from a procedural error in his asylum application, such as a missing signature. They vowed to appeal by April 17 and demand his release pending appeal, describing it as unjust.
In any case, City Council Speaker Julie Menin whined, “Today, Judge Conroy ordered the removal of Rafael Rubio, our City Council employee, from the United States. We are outraged and will continue to pursue every legal avenue to secure his release and ensure his case is properly heard on appeal.”
In a similalry hysterical post to social media, Mayor Zohran Mamdani complained, “This is an affront to justice. A dedicated public servant with legal authorization to remain in the country, Rafael showed up for a routine immigration appointment and, despite following the rules, he was detained and has now been held for months.”
“Today’s ruling appears to hinge on a procedural issue related to his asylum application. That is extremely troubling. A technical error should not determine the fate of a man who has done everything right and poses no risk to anyone,” Menin continued.
Finally concluding her long-winded comments, she added, “Let me be clear: Rafael should not continue to be detained while this is sorted out. An appeal will be filed, and we demand that Rafael’s case be properly heard by the deadline on April 17. At a minimum, he should be released pending that appeal. There is no justification for continuing to hold him under these circumstances.”
Infamous Attorney General Letitia James said, “This deportation order is outrageous. Rafael Rubio is a New York City Council employee. He is legally permitted to be in the country, but was still met with this unjust detainment at a routine check-in. He followed the law. He should be released.”
