A 19-year-old illegal alien named Julian Montayo is accused of killing a six-year-old boy in Watford City, North Dakota. Arrested last month and charged with negligent homicide, duty in an accident involving death, and driving without a license, he now faces 15 years in prison if convicted.
Montayo allegedly ran over and killed a six-year-old boy named Matteo Garcia who was adjusting the seat on his bicycle at the time of the deadly accident.
The Bismark Tribune, describing the horrific accident itself and the charges Montayo faces, reported:
Julian Montoya, 19, of Watford City, is charged with negligent homicide and duty in an accident involving death. The two charges together carry a maximum sentence of 15 years in prison. Northwest District Judge Robin Schmidt scheduled a trial starting Sept. 18, court records show.
Montoya is accused of striking the boy the night of Saturday, April 8, while the boy adjusted his bicycle seat. Montoya allegedly went over to the child and apologized, then went to the pickup as though he was going to leave. A witness took the keys and Montoya went inside the apartment building. He returned to the scene a few minutes later, the Highway Patrol said. Montoya allegedly told authorities he thought he was going 5 mph and went into shock after hitting the boy.
The witness told investigators Montoya was going fast as he rounded a corner in the parking lot and made no attempt to stop, according to a Patrol affidavit. Black tire marks after the turn “appear to be skid marks consistent with rear tires spinning due to rapid acceleration,” the document states.
A GoFundMe for the boy’s family that has raised over $30,000 says, “We are asking for your generosity to help with Matteo’s funeral expenses and support for his family who lost him in a tragic accident. His family came to the US from Guatemala not to long ago and are trying to build a future in the United States. Your support for this family will be greatly appreciated.”
Tammy Nobles lost her 20-year-old daughter Kayla Hamilton in 2022. Kayla, an autistic woman, did not die of natural causes. Instead, she was reportedly strangled to death by an illegal immigrant affiliated with the gang MS-13 last year.
Nobles just tore into President Joe Biden and his stance on border security and illegal immigration during an appearance on “Fox & Friends First,” raking him over the coals by sharing her heart-wrenching message.
Speaking to FNC’s Ashley Strohmier on Tuesday, Nobles said, “If there was a more secured border and individuals coming here was properly vetted, my daughter would still be alive today. They let her down.”
Continuing, she said that she thinks immigrants should have to be properly vetted to be in the United States, telling Strohmier, “I want them to be properly vetted. They need to be able to check their background, not for crimes in this country, but also crimes in their country and where they came from.”
Then, when asked if she ever thought that such a tragedy would strike her family, she said, “Not in a million years. I never thought I would lose my daughter at 20 years old.”
