Manhattan District Attorney Alvin Bragg is facing backlash in the wake of former Marine Daniel Penny’s acquittal in the death of Jordan Neely over the 2023 incident on a New York subway. Conservatives continually blasted the case brought against Penny, who many argue was a hero for defending his fellow passengers, where calls for Bragg to be fired are growing.
Voicing his opinion, former New York City Mayor and Trump ally Rudy Giuliani called on Governor Kathy Hochul to remove Bragg. “A great act of justice by 12 fair New Yorkers rejecting the racist, unjust charges of Bragg, the Soros imposed DA. Daniel Penny is a hero and deserves a medal from NYC and @realDonaldTrump. Hochul should remove Bragg, now!” Giuliani wrote.
The post sparked an immense reaction from conservatives in the comments section, expressing their agreement with Giuliani. “This was a call to get a sane, crime free NYC back like the one you gave to us, sir. They should look at your administration as a guidebook to success and prosperity for the citizens of the city,” one person wrote.
“I am amazed and heartened to see a group of regular New Yorkers find not guilty and reject this unjust prosecution. Rittenhouse prosecution was in purple area, Manhattan is deep blue. Faith in humanity given a lifeline,” another person wrote, reacting to Penny’s acquittal.
The American Tribune previously reported on Penny’s account of what occurred when he restrained Neely on the subway in May 2023. “He was just threatening to kill people. He was threatening to go to jail forever, go to jail for the rest of his life. And now where I’m on the ground with him, I’m on my back in a very vulnerable position. If I just would have let go now, he’d turn,” the former Marine said.
“I’ll take a million court appearances and people calling me names and people hating me just to keep one of those people from getting hurt or killed,” Penny continued. He then highlighted how local officials ultimately failed Penny. “These are their policies that are, and I don’t mean to get political, I don’t really want to make any enemies, really although I guess I have already. But I mean, these are their policies that have clearly not worked, that the people, the general population, are not in support of, yet their egos are too big just to admit that they’re wrong,” he said.
Recounting how the situation unfolded, Penny said, “I got out of class around 2:15, I took the J Street. I was at J Street Metro Tech took the Uptown half train at Second Avenue. A man came on, stumbled on. He appeared to be on drugs. The doors closed, and he ripped his jacket off and threw it at the people sitting down to my left.”
Penny continued, “I was listening to music at the time he was yelling, so I took my headphones out to hear what he was yelling, and the three main threats that he repeated over and over was, ‘I’m going to kill you. I’m prepared to go to jail for life, and I’m willing to die.’”
The young man added, “You know, this is a this was a scary situation. And Mr. Neely came on. He was, he was threatening, I’m six two, and he was taller than me. So it was, there’s a common misconception that Marines don’t get scared, or actually taught one of our core values is courage and courage … courage is not the absence of fear but how you handle fear. You know, I was scared for myself, when I looked around I saw women and children. He was yelling in their faces. Say, saying these threats.”
