As her Attorney General and the relevant sheriff refuse to support or defend Governor Grisham of New Mexico’s public health order banning the carrying of firearms in Albuquerque or the surrounding county, she just got hit with even more bad news, as Gun Owner’s of America just won a courtroom battle and got a temporary restraining order placed on the public health order.
As background, Gov. Grisham announced the order, which is effective for 30 days with the option to renew it present, in response to a spate of shootings in Albuquerque that left children dead. However, instead of cracking down on the criminals carrying out such cold-hearted shootings, her order bans even concealed carry holders from carrying weapons, thus disarming the law-abiding and doing nothing to stop criminals.
The order was swiftly challenged in court by guns rights groups, such as Gun Owners of America, with those groups arguing that the law is unconstitutional. Those groups quickly won an early victory, with a temporary restraining order being placed on the ban as the issue works its way through the courts system.
Gun Owners of America announced its victory on X (formerly Twitter), saying, “🚨BREAKING🚨 GOA and @GunFoundation have received a Temporary Restraining Order against New Mexico Governor’s tyrannical firearm carry ban. This is a win for all gun owners in New Mexico and sends a clear message to all anti-gun states—Shall NOT Be Infringed.👏”
Commenting on the order, GOA executive vice president Erich Pratt said, “GOA will continue pressing to extend this Temporary Restraining Order into a permanent order. And we will not rest until all those in New Mexico who played a role in this action are held accountable for this gross assault on our rights.”
Shortly after the ban was announced and the suit commenced, Pratt said, “Gun Owners of America has filed a federal lawsuit challenging Governor Michelle Lujan Grisham’s gross and egregious violation of the U.S. Constitution. Her claim that there are ‘exceptions to the Second Amendment’ is not only wrong, but it also blows open a huge hole in the Bill of Rights. GOA will not rest until the rights of New Mexicans are restored.”
The GOA also took to X to expose the ludicrous nature of Gov. Grisham’s defense of the obviously unconstitutional order, saying, “🚨BREAKING🚨 At the GOA and @GunFoundation oral arguments, the Attorney representing New Mexico Governor Grisham concedes that “no law” may infringe the Second Amendment, instead arguing that the order isn’t a law it’s an executive action, and therefore should be allowed.🤯”
Gov. Grisham attacked the 2nd Amendment in a press conference as well, saying, “The purpose is to try to create a cooling off period while we figure out how we can better address public safety and gun violence. There are gonna be a lot of questions about whether or not we think we have the legal rights to do that. I am sure…there will be a legal challenge, and I can’t tell you that we [will] win it, given all of the different challenges to gun violence laws and restrictions on individual firearm access and control….I think it’s time to talk about the absoluteness of the discussion and the current court actions that suggest that the Second Amendment is an absolute right.”
