Sending the deep state reeling, the Department of Justice (DOJ), led by Attorney General Pam Bondi, slammed the state of Minnesota with a major lawsuit for offering free or reduced in-state tuition to illegal immigrants. Bondi described the program as unconstitutional and discriminatory against U.S. citizens, meaning that it violates federal law.
For context, this lawsuit follows a similar victory against Texas, where the Texas Dream Act was stopped. Strengthening the DOJ’s case, President Trump’s executive orders, “Ending Taxpayer Subsidization of Open Borders” and “Protecting American Communities From Criminal Aliens,” ban programs like these.
In any case, Pam Bondi issued a confident statement saying, “No state can be allowed to treat Americans like second-class citizens in their own country by offering financial benefits to illegal aliens. The Department of Justice just won on this exact issue in Texas, and we look forward to taking this fight to Minnesota in order to protect the rights of American citizens first.”
Opposing this obviously sensible lawsuit, the ACLU argued, “As students prepare to attend school in the fall, the failure of neither the DOJ nor the attorney general to defend the Texas Dream Act threatens their ability to afford tuition – and suddenly threatens their dreams of pursuing higher education.”
Apparently, Minnesota was not the only state to be slapped with a lawsuit concerning free tuition to illegal immigrants, according to popular conservative influencer Libs of TikTok, “JUST IN: The DOJ is suing Kentucky over policy offering discounted college tuition for illegal aliens. The suit alleges the law unconstitutionally discriminates against U.S. citizens not afforded the same privilege.”
In the comments under her June 19, 2025, post, conservatives were incensed by the perceived unfairness of the program. One such comment said, “Kentucky’s policy is a slap in the face to every American student drowning in debt. The American Students First Act (H.R. 2374) explicitly bars federal funding from colleges that prioritize illegal aliens over citizens. Yet Kentucky’s Council on Postsecondary Education keeps funneling taxpayer-subsidized tuition to those here unlawfully while charging Virginians and Tennesseans full price.”
Building on this point, another local woman said, “And most Kentuckians support the DOJ suing over this. KY went for Trump by 30+ points. We are a Red state with 3 blue cities. That’s it. We don’t want illegals getting in state tuition. We want them DEPORTED. @GovAndyBeshear is the WORST.”

Recognizing how the issue could swing young voters for the GOP, one comment noted, “How does MAGA get Millennials & GenZ on our side? Tell them about this as they’re paying a ridiculous college loan that Liz Warren started by taking away loans from banks which raised tuition 150%.”
Annoyed by the free tuition scheme, another conservative replied, “How have they been getting away with treating illegal immigrants better than American citizens in our own country? Who makes up these stupid rules?” Agreeing, another said, “So glad they’re finally using the word “Discrimination”! That’s exactly what they are doing-discriminating against American Citizens simply because we are legal American Citizens.”
Asking for more lawsuits, another comment begged, “Come to California- Ventura community college lets illegal aliens enroll tuition free, textbook free & graduates students who can’t write in important programs like ‘LAW- paralegal.’ Some of my classmates can’t write & graduated as paralegals.”
