Former CIA Director John Brennan has been issued a subpoena requiring him to deliver testimony before a Florida grand jury as part of a Justice Department probe into whether former law enforcement and intelligence officials worked together against President Donald Trump. Brennan’s attorney, Ken Wainstein, released a court filing that revealed prosecutors presented Brennan with a subpoena to appear October 15, 2026 before a grand jury in Fort Pierce, Florida.
Wainstein then said that the subpoena is connected to a “far-reaching” criminal probe examining whether government officials who have previously investigated the president over the last ten years have conspired to deprive him of his civil rights. A prosecutor also informed him that Brennan remains a target in a separate Washington-based investigation looking into whether he lied to Congress in 2023, despite his having completely denied those allegations.
This latest development comes as leadership upheavals continue within the investigation. The subpoena was delivered on the same day that Joe diGenova, the prosecutor currently leading the inquiry informally known as the “grand conspiracy” investigation, stepped down from his post. As of this writing, the DOJ has not publicly named his replacement.
According to a report from Fox News, Wainstein also said that he talked with Kurt Olsen, who is on the investigative team and served as an attorney who urged the DOJ in 2020 to support President Trump’s claims that the presidential election had been stolen. The disclosure of Brennan’s subpoena came a few hours ahead of a scheduled court hearing in the nation’s capital concerning a lawsuit that was filed by the former CIA director.
Brennan is seeking a court order that would preserve all records related to investigations targeting him, making the case that these documents are essential to challenge any potential indictment on grounds of vindictive prosecution. There were a lot of hot takes in the comment section on a Facebook post about the subpoena, where the vast majority of those backing Trump didn’t hold back their thoughts on Brennan.
“He might as well have a recording with a button that pleads the 5th so he doesn’t lose his voice,” one user said, making a reference to the last testimony that former director of the National Institute of Allergy and Infectious Diseases Anthony Fauci delivered in which he pleaded the 5th Amendment an astounding 111 times.
Someone else chimed in with a joke related to the same premise, saying, “As per advice from counsel, I would like to express and exercise my Fifth Amendment Right!” Another said, “I can already tell you what his testimony will be, “By advice of counsel I invoke my Fifth Amendment right.” One person wrote a comment about the justice system saying, “The wheels of justice grind slowly, but they do grind.”

“It’s so funny that the guy who loves to scream ‘witch hunt,’ is the one actually out here doing the witch hunting,” someone else said, making a reference to all of the various efforts put together by radical leftists over the last several years to try and nail President Trump with some sort of illegal activity to prevent him from becoming president in 2024.
