Rogue, Woke Judge Rules Trump Can’t Deport Non-Citizens Who Express Support for Terror Groups

As radical left-wing attorneys continue to utilize lawfare tactics to push through their assaults on national sovereignty and immigration enforcement, activist judges have repeatedly handed down rulings that demonstrate they are far more dedicated to establishing globalism than defending the Republic, a district judge has sided against the Trump administration’s revocation of visas for those who have expressed support for terrorist organizations.

U.S. District Judge Noel Wise from the Northern District of California, whose positions were so far to the left they were called “insane” during her confirmation hearing, handed down a decision that ruled against Secretary of State Marco Rubio’s use of the Immigration and Nationality Act for deportations that are based on an individual’s support for terrorists.

The ruling came after the Stanford Daily Publishing company filed a lawsuit on behalf of an anonymous foreign student who alleged First and Fifth Amendment violations. “In the United States, freedom of speech belongs to the people. It is not the government’s to take,” contended Wise, who then added, “Here you can simultaneously hate the content of a person’s speech and love the country that cherishes the freedom to allow it.”

“Zealous protection of our Constitutional right to free speech is a provocative demonstration of our country’s powerful lack of fear,” Wise continued, according to a report from BizPacReview. The judge then summarized the case in her own words in a lengthy part of the written decision, clearly utilizing her authority to push her own political agenda.

“Plaintiffs allege that, since March 2025, the government has changed its immigration policy and pattern of enforcement, namely by arresting, detaining, and deporting students with F-1 visas when those students use their freedom of speech to express opinions that the government does not like–such as expressing support or empathy for Palestinian people, or criticizing Israel’s actions regarding Palestine or the conflict in Gaza.”

Popular conservative social media influencer Libs of TikTok was able to create a more succinct and accurate summary of the case, writing, “Biden-appointed judge Noel Wise just ruled that the Trump admin CANNOT deport foreigners who express support for terrorist organizations.” The government had, until recently, made it abundantly clear that visas are a privilege not to be granted to those who prove themselves a threat to the country or U.S. foreign policy interests.

That most definitely includes individuals who express support for terrorist organizations. A State Department spokesperson, speaking with Politico, said that the United States “is under no obligation to admit or suffer the presence of individuals who subvert our laws and deny our citizens their Constitutional rights.”

“More broadly, the Department of State is committed to protecting our nation and its citizens by upholding the highest standards of national security and public safety through our visa process,”  the spokesperson explained. “A visa is a privilege, not a right.” Sen. Josh Hawley (R-MO) called Wise’s political views “insane” during her Senate Judiciary Committee confirmation hearing.

Hawley challenged Wise’s suggestion that laws segregating bathroom use based on biological sex were a “violation of church and state.” Elon Musk, CEO of SpaceX and Tesla, called her latest ruling “madness” in a reply to White House deputy chief of staff Stephen Miller saying, “A district court judge says America must admit and keep foreigners who hate America and hate Americans. Court-ordered civilizational suicide. It will not stand.”
