Rep. Brandon Gill (R-TX) is now in charge of a House Oversight Committee probe into birth tourism agencies that are assisting foreign nationals in delivering their babies on United States soil for the purpose of securing them birthright citizenship in America. Reports emerged several weeks ago that Gill’s Task Force on Defending Constitutional Rights and Exposing Institutional Abuses has sent several letters to four birth tourism agencies.
The list includes: Have My Baby in Miami, Florida; Maternity Services of El Paso, Texas-based International Maternity Services; Doctores Para Ti in El Paso, Texas; and Dr. Athiya Javid’s OB/GYN clinic in San Diego, California. In the letters, Gill is requesting that each of these agencies provide documents on their childbirth packages, including materials related to how foreign clients are coached about securing a temporary visa to legally enter the United States while avoiding revealing their true purpose for giving birth in the U.S.
“While it is not inherently illegal for a foreign traveler to give birth in the United States, willfully misrepresenting one’s intentions to enter the country on a temporary visitor visa is a violation of current law and considered visa fraud,” Gill went on to write in a letter addressed to Have My Baby in Miami executives. “The birth tourism industry relies on exploiting birthright citizenship as currently interpreted under the 14th Amendment of the U.S. Constitution.”
According to a report from Breitbart News, Gill explained how these agencies are operating across the country in a viral post on social media. “Have My Baby in Miami — that’s the name of an actual company that is facilitating birth tourism into the United States, where foreigners come in on visas, have children, then leave so that their children can remain American citizens,” Gill says in a video included in the post.
“That’s a problem. The American people are sick of it, and my task force on the House Oversight Committee is going after these companies,” The Texas Republican said. Data has revealed that there are an estimated 33,000 U.S.-born children who are given birthright citizenship due to their parents arriving in the U.S. on a temporary visa, often just a tourist visa.
The ultimate end goal of such a practice seems to be raising the children to adulthood where they can then sponsor their foreign-born parents for green cards. According to Breitbart, the birth tourism industry is hugely popular among Turkish nationals living in New York City, Chinese nationals in California, Russian nationals in Florida, and Middle Easterners in Illinois.
The report also revealed that in December 2020, the Justice Department uncovered a huge birth tourism scheme in New York City, where over 100 U.S.-born children to foreign visitors were handed birthright American citizenship. Before that, in 2019, the DOJ uncovered a similar scheme happening in California involving Chinese nationals.

A total of 8,500 U.S.-born children were given birthright American citizenship after their parents, born in China, arrived in the United States on tourist visas, for the sole purpose of delivering their child on American soil.
