Derrick Evans, a former West Virginia state delegate, who served three months in prison and 10 days in solitary confinement for his participation in the January 6 protest, slammed the Department of Justice (DOJ) for its “special treatment” of Democrats who committed similar crimes.
For context, during the dramatic storming of Delaney Hall detention facility in Newark, New Jersey, on May 9, 2025, Democratic Rep. LaMonica McIver (D-NJ) physically assaulted a federal agent. A high-octane video of the protests shows McIver screaming curses and threats, including “I touch whoever I want, motherf*cker!” while assaulting the agents.
Stating his case in a video, posted to X on May 30, 2025, Derick Evans said, “I was an elected representative from West Virginia on January 6, when I was peacefully protesting, I never shoved or hit police officers. My interaction with the police officer was, it’s on video. I was saying, ‘Thank you, sir for your service. God bless you.’ And he gives me a friendly fist bump.”
Continuing his story, he recounted, “I was facing 24 years in prison, thrown into solitary confinement, ripped away from my family. No one is above the law, apparently, unless you have a D in front of your name. If you’re a Democrat, they think you’re above the law.”
In the caption to his post, Evans stated, “I was an elected representative from West Virginia on January 6th, but that didn’t matter when they raided my home, ripped me from my family, and threw me into solitary confinement. Why is the Democrat Congresswoman from NJ getting special treatment? ‘No one is above the law.'”
In the comments under his post, conservatives rallied behind the West Virginia state representative. One such comment read, “Apparently these people seem to have a pact or club. We won’t prosecute you and you won’t prosecute me ….kind of thing. What else can describe this?” Building on this point, another said, “Certainly no one SHOULD be above the law, but we see time and time again that this isnโt true.”
Frustrated by the double standard, one user noted, “This is true. And why we want, no need people on the other side to go to Jail for their part in illegal activity. We have seen no equal justice. This is not good for a healthy democracy.”

Thanking Evans for his bravery, despite persecution from the Biden DOJ, a comment declared, “Thank you for your continued patriotism, your courage to speak truth and reason even after the brutal way you and your family have been treated. ๐๐บ๐ธ๐”
Explaining why this case is essential, a conservative noted, “Our Constitution guarantees Equal protection under the law. If judges do not apply the law equally they must be discharged/impeached/charged with failure to uphold oath/denial of Civil Rights, liberties etc.”

Rounding out the comments, one user expressed their anger with the Democrats, saying, “The entire democrat party is above the law. They make up most of the legal system, fed, state and local. Itโs obvious enough that anyone would have to be in denial to not acknowledge it. They still make up near half of the legislative branch as well.”
