Representative Eric Swalwell (D-CA) appeared on MSNBC’s “Deadline” on Tuesday, December 10, telling host Nicolle Wallace during the interview that his lawsuit against now-President-elect Donald Trump over the events that occurred on January 6, 2021, is “not going away” despite Trump’s re-election in the 2024 presidential election.
As background, in 2021 Swalwell sued then-former President Donald Trump, his son Donald Trump Jr., Rudy Giuliani and Republican Rep. Mo Brooks, arguing in the case that “The horrific events of January 6 were a direct and foreseeable consequence of theDefendants’ unlawful actions. As such, the Defendants are responsible for the injury and destruction that followed.”
In any case, host Nicolle Wallace, broaching the issue of Swalwell’s continuing war on now-President-elect Donald Trump from inside the legislature, alongside similarly minded legislators, asked, during a conversation on the January 6 committee, “Congressman I heard you have votes, if you have one more minute I would love to give you the last word.”
Rep. Swalwell, responding, said that he wants to remind Americans that he is “not going away,” saying, “I do. I will tell you I had lunch with Harry and some of the other officers today with Speaker Pelosi. I wanted to just share with them obviously gratitude during this season of thanks, but also that I am not going away.”
Continuing on that same point, Rep. Swalwell noted that other Democratic Party personalities are not planning on “going away” either, telling Nicolle Wallace, “Adam Schiff and others are not going away. A whole new crop of leaders like Dan Goldman, Jasmine Crockett, Jared Moskowitz, they are not going away.”
Rep. Swalwell then added, commenting on his January 6 lawsuit against the president-elect and on how it is still around, saying, “I still have a January 6 lawsuit joined with other January 6 officers that is not going away. We are actually proceeding. Just last week we deposed some of the highest ranking officials in the Trump administration, some who are going back into the Trump administration.”
Further, he added, “So we are headed to trial. There is precedent that does not allow Donald Trump to get rid of this while he is president. So we are still seeking accountability. As long as the American people stand tall for fairness and justice and equality, I am going to stand tall. I need people at home to be just as strong as Harry Dunn and we are going to get through this.” Watch him here:
In his suit, shortly before alleging that Trump and the others are responsible for damages, Swalwell said, “As the Plaintiff and hundreds of others—including police officers, other elected officials, and rank-and-file workers at the Capitol—were put in mortal danger, and as the seat of American Democracy was desecrated by the insurgent mob, the Defendants watched the events unfold on live television.”
Continuing, Swalwell’s suit next went on to allege, “Those with knowledge claimed that during this moment of national horror, Trump was ‘delighted’ and was “confused about why other people on his team weren’t as excited as he was.’ Others described Trump as ‘borderline enthusiastic’ about the unfolding violence.”
