Do you want the border to go from being a porous line across which a veritable smorgasbord of welfare-seekers, drug mules, and future criminals can walk at will? Well then you just got more good news from the court system, which just blocked Biden from imposing limitations on arrests, detentions, and removals by Immigration and Customs Enforcement.
That ruling came from Southern District of Ohio Judge Michael Newman in response to a lawsuit that was filed by Republican Attorneys General of Arizona, Montana, and Ohio.
Those AGs would be Arizona Attorney General Mark Brnovich, Montana Attorney General Austin Knudsen, and Ohio Attorney General Dave Yost. The suit was filed in 2021, with the AGs claiming that the Biden policy of imposing limits on ICE’s ability to arrest lawbreakers “dramatically ties the hands of immigration officers, halting nearly all deportations.”
Judge Newman, in response to their lawsuit, issued a preliminary injunction blocking the imposed limits. Writing on why in the ruling, Judge Newman said:
“The States sue because they believe DHS skirted Congress’s immigration enforcement mandates when it issued a policy that prioritizes certain high-risk noncitizens for apprehension and removal. DHS contends that seemingly mandatory statutes must be read flexibly to permit efficient law enforcement. At bottom, that is what this dispute is about: can the Executive displace clear congressional command in the name of resource allocation and enforcement goals? Here, the answer is no.”
This ruling is just the latest loss for Team Brandon, which also lost a recent SCOTUS case on Title 42, with the Supreme Court blocking the expiration of the policy.
Team Biden has, since that ruling, insisted it will defend the border, with the Department of Homeland Security’s Assistant Secretary of Public Affairs, Marsha Espinosa, saying in a Twitter thread:
As required by today’s Supreme Court order, the Title 42 public health order will remain in effect and individuals who attempt to enter the United States unlawfully will continue to be expelled to Mexico or their home country.
People should not listen to the lies of smugglers who take advantage of vulnerable migrants, putting lives at risk. The border is not open, and we will continue to fully enforce our immigration laws.
We will continue to manage the border, but we do so within the constraints of a decades-old immigration system that everyone agrees is broken. We need Congress to pass the comprehensive immigration reform legislation President Biden proposed the day he took office.
Despite that, many red state governors think that the Biden Administration is not doing enough to defend the border with Mexico, with Governor Abbott of Texas stepping up to the plate to defend the Texa-El Paso border by ordering the Texas National Guard to use shipping containers and three layers of concertina wire to build a border barrier.
That order came after the El Paso mayor declared an emergency and requested state and federal assistance in dealing with the border crisis.
The argument that the border needs to be strengthened was bolstered by the recent news that the Biden Administration has lost track of over a hundred thousand illegal immigrants, with Fox News Digital reporting:
“New excerpts from Immigration and Customs Enforcement (ICE) training videos reveal the challenges faced by border officials due to the Biden administration’s relaxed ‘no processing’ immigration policy, which resulted in the government losing track of at least 150,000 illegal migrants in the summer of 2021. The videos, first obtained by Fox News Digital, show border officials discussing logistical issues they are dealing with after hundreds of thousands of illegal immigrants were released into the interior of the country without thorough processing.”
The same report added that the “Biden administration enacted ‘Operation Horizon’ in November 2021 to attempt to locate over 150,000 released migrants and send their official charging documents by mail. However, the ICE training videos show that border officials were restricted in their ability to locate and remove illegal migrants without identifying information on them.”
