In huge news from mid-September, conservative podcaster Tim Pool announced that he is going on the legal counteroffensive against the campaign of Vice President and 2024 Democratic presidential nominee Kamala Harris, alleging in the suit that she has interfered with his attempts to do business as a podcaster by posting a false statement and defaming him.
In fact, Pool fired the lawsuit in West Virginia against the Harris 2024 Campaign over what he alleged in the suit was a defamatory statement posted by, and bad-faith misconduct conducted by, the campaign’s “KamalaHQ” account on X (formerly Twitter). That account serves as the campaign’s press account.
The tweet at issue was posted on August 31. It included a clip of Pool speaking about Trump imprisoning Democrats and the caption, “Trump operatives say their Project 2025 plan is to give Trump total, unchecked legal power so they can jail and execute those who don’t support Trump if he wins.” It added, “(They have since scrubbed this video from YouTube).”
In the clip itself, Pool, speaking about how Trump should respond to the lawfare he has faced under the Biden Administration’s time in power, said, “Should Democrats be in jail? No question.” Pool continued, “When Donald Trump gets elected, should he start locking them up? No question. Should there be lists of Democrats that need to go to jail, one hundred percent. And the reason for that is they committed crimes.”
Pro-Trump personality Laura Loomer sounded off in the comments section of the KamalaHQ post, saying, “This is a lie. The words Project 2025 were not mentioned once during this episode. The episode was deleted from YouTube by @Timcast live on air because I mentioned the punishment for treason per our constitution is DEATH.”
She continued, “Tim said you’re not allowed to say that on YouTube and he was worried he would get a strike so he killed the episode live on air and moved it to rumble instead. We were not talking about Project 2025. The full episode is on @rumblevideo so people can see the truth themselves!” She added, “It was never “scrubbed”. It was deliberately removed in the moment by Tim Pool so that his channel wouldn’t be penalized.”
Pool agreed with Loomer’s take, apparently, as he filed a lawsuit against the Kamala Campaign, specifically its KamalaHQ X account. Tweeting about that, he said, in part, “I have filed my lawsuit against @KamalaHQ. I will be going over the filing on the show.” Pool also said, “I believe that they know they are lying.” He added, “It is so antithetical to my views. It is the exact opposite of what was being said in the video.”
The lawsuit itself noted that Pool, far from being a Trump surrogate, holds a much more libertarian-type worldview and that he previously supported Obama and Bernie. “If anything, Mr. Pool’s worldview is woven together by a common thread: deep skepticism of corporate and state power,” the lawsuit provides.
Further, it noted that the tweet did not “couch” the claim about him as an opinion, nor did it “hedge.” “To the contrary, to any reasonable reader, the Harris Campaign was saying that Mr. Pool wants to suspend the Constitution, make President Trump dictator, and use state power to imprison and kill Mr. Pool and President Trump’s political opponents,” the lawsuit provides.
Continuing, it notes that the Harris campaign framed his comments as being utterly abhorrent and associated with some of the worst regimes. It said, “According to the Harris Campaign then, Mr. Pool’s ‘plan’ is to imitate one of the hallmarks of the most abhorrent, murderous regimes of the past and present.”
Pool also argued, “Kamala Harris is the Democratic candidate for the presidency who posted on her official campaign’s social media platform that I advocated for this.” He continued, “I am not a Trump operative. I am not part of Project 2025. I have never — never — advocated for the death penalty. I strongly oppose it and passionately argue against it.”
