The Supreme Court of Colorado recently decided that Section 3 of the 14th Amendment disqualifies former President Donald Trump from being on the ballot because of the January 6, 2021 “insurrection.” Speaking to Breitbart News Daily, Trump lawyer and legal spokeswoman Alina Habba discussed what is being done to fight back against the decision and what she sees it as being about.
Particularly, Habba argued that the Colorado decision, which that court ruled would not go into effect until early January to give the United States Supreme Court time to rule on the decision, would be overturned by the Supreme Court and that the goal of those behind bringing the case and ruling on it was to stop Trump no matter what.
Speaking to Breitbart about the decision to say Trump is ineligible for “insurrection” despite there being no conviction of Trump on such a charge, Habba said, “I find it ironic that there’s a January 6 charge pending, but due process doesn’t matter because Colorado’s liberal judges want to take him off the ballot because they can’t beat Biden in the ballots.”
Continuing, she bashed the Colorado Supreme Court and said it had obviously violated the Constitution and would look clowning when the Supreme Court said so, telling Breitbart News Daily, “You’re not a pioneer. You’re going to look ridiculous. You do not understand due process. You do not understand the Constitution. You are literally a state-level court that is going to look ridiculous, okay, when the Supreme Court — whether you’re a federal judge or a state judge — when the Supreme Court overturns you, that’s not a good look.”
Then, emphasizing the due process side of the issue, Habba added, “And there is no question in my mind. Due process exists for a reason. There has to be some America left.” She added that the answer to the question is obvious because of that due process issue, saying, “I’m not even concerned that the Supreme Court will make the right decision here.”
Continuing, Habba said that the attempt to keep Trump off the ballot is “so desperate,” saying, “It’s absolutely ridiculous, and it’s so desperate. It’s just so desperate.” She added, “We can’t even, we don’t even have the option in Colorado to vote for who we want. The leading candidate, we don’t even have the option because they’re so afraid.” She also tore into the Colorado Supreme Court’s behavior as “anti-American, self-interested behavior that they will go as far as to take away your option to vote for President Trump.”
Further emphasizing that point and drawing attention to how ridiculous she thinks the ruling is, Habba said, “That is so sad and pathetic, frankly. I mean, it’s just ridiculous. I have no words. I’m rarely speechless, as you know. But I am speechless.”
Then, describing what she thinks the decision is really about at its root, she said, “This is about one thing: November. So there used to be an October surprise right — and there still will be, by the way — there used to be an October surprise.” She added, “So they already did the Russia hoax. They got caught on that. So now we have to do something different. That’s what this is. The radical left is desperate, and it’s obvious and pathetic.”
