It goes without saying that former President Donald Trump faces a daunting legal battle ahead of the 2024 presidential election. Trump has been hit with four indictments totaling 91 charges, where if convicted of all, he could be sentenced to over 700 years in prison.
The former president has indicated that he is confident he will be able to win the presidential election in 2024 despite this legal battle. Undoubtedly, there are many woke leftists in America that want Trump behind bars for the rest of his life. However, it’s important to assess the likelihood of this actually happening.
Even left-leaning CNN’s senior legal Analyst, Elie Honig, admits the chances of Trump being imprisoned are very slim, contingent on him being able to beat Joe Biden and win back the presidency. However, Honig made it very clear that he wishes for Trump to be jailed, stating, “Trump deserves to be indicted. Let’s start with that.”
“He has to be convicted, which could well happen. I actually think it’s quite possible. Then he has to be sentenced to prison, which I think in any of those three cases [excluding the New York indictment] is likely. Then, though, if he wins the election, forget it. If he wins the election, he’ll throw out the DOJ cases, he’ll pardon himself,” the legal analyst explained.
Honig also claimed that even in the case of the Georgia indictment, which Trump would not be able to dismiss or pardon himself on, they would not be able to put him on trial if he is actively serving as president. “They’re not going to be able to try him while he’s sitting president,” he said.
Highlighting that the Fulton County District Attorney is only a county-level prosecutor, Honig suggests that it is highly unlikely any judicial action taken against Trump in the Georgia case would not be efficacious.
“I mean, constitutionally, given the federal supremacy doctrine, there’s no way the federal courts will allow a count. She’s a county level prosecutor. I mean, that would be the same thing as if the Sussex County New Jersey I don’t live in Sussex County, but like the Sussex County New Jersey prosecutor tried to put Joe Biden on trial right now,” Honig stated. “That would never happen. I’ve heard people say, ‘Well, constitutionally, we don’t know.’ I’m sorry. My legal analysis on this one boils down to: That ain’t happening” Honig summed it up.
Honig further emphasized how there are so many challenges to each of the case Trump is facing. According to the legal analyst, one of the most significant is that Trump would not face imprisonment prior to the election. This would give him an opportunity to challenge the cases from the position of president, as Honig discussed previously.
“But my point is, with all these cases, there’s 3,4,5 substantial hurdles that need to be overcome. By the way, he is not going to get locked up before the election no matter what, because even if he gets convicted, and then sentenced to prison, all before the election, he will almost certainly get what we call bail pending appeal, meaning the judge will say, you don’t have to start serving your time until you’ve exhausted and lost all your appeals.”
